Forumul Judecătorilor condamnă lipsa oricărei reacții de conformare la recomandările GRECO din partea CSM, în frunte cu președintele său, ales temporar pentru anul 2019

Forumul Judecătorilor din România condamnă lipsa unor reacții la recomandările GRECO din partea Guvernului, Parlamentului dar și a CSM. Într-un comunicat public, Forumul Judecătorilor apreciază ca ultimele rapoarte critice cu privire la situația sistemului judiciar din Romănia trebuie aplicate, pentru că, in caz contrar, se pune în pericol parcursul european al României ca stat membru. Mai mult chiar, judecătorii susțin că, potrivit art. 11 din Constituția României, statul român și-a luat angajamentul să pună în aplicare tratatele internaționale la care a aderat.

Asociația „Forumul judecătorilor” cere autorităților din România să respecte recomandările cu privire la statul de drept venite din partea instituțiilor internaționale:  Comisia de la Veneția, Consiliul Consultativ al Judecătorilor Europeni sau GRECO (organisme din cadrul Consiliului Europei), dar și de Comisia Europeană și multe alte entități ale Uniunii Europene, instituții din care România face parte.

Forumul Judecătorilor din România condamnă lipsa oricărei reacții de conformare la recomandările GRECO din partea puterii legislative sau a puterii executive, precum și atitudinile unor membri ai Consiliului Superior al Magistraturii, în frunte cu președintele său, ales temporar pentru anul 2019, de respingere a unor critici ale organismelor internaționale și/sau europene asupra unor aspecte esențiale, sunt inacceptabile într-un stat de drept și pot pune în pericol însuși parcursul României ca stat membru al Consiliului Europei.

Asociația Forumul Judecătorilor din România salută ultimele rapoarte extrem de critice emise de GRECO cu privire la situația independenței sistemului judiciar din România, organismul Consiliului Europei fiind preocupat în mod special ”de faptul că recomandarea de a se renunța la înființarea Secției pentru Investigarea Infracțiunilor din Justiție a fost complet ignorată”, aspect care, împreună cu ”numirile și eliberările din funcție a procurorilor de rang înalt, independența funcțională a procurorilor, răspunderea materială a judecătorilor și procurorilor etc. reprezintă amenințări serioase la adresa independenței sistemului judiciar în România”.

GRECO veghează la punerea în practică a angajamentelor statelor membre de a-și uni eforturile, de a-și împărtăși experiențele și de a acționa împreună în acest domeniu, prin intermediul unui proces dinamic de evaluare și presiune reciproce. Rapoartele de evaluare trebuie privite ca fiind rezultatul unei analize obiective, realizate de un observator extern și neutru, concluziile lor trebuie apreciate la nivelul unui înalt standard de profesionalism și respectate întocmai de statele membre, în cadrul cooperării loiale și al evaluării reciproce dintre acestea.

Reiterăm că, potrivit art. 11 din Constituția României, Statul român se obligă să îndeplinească întocmai și cu bună-credință obligațiile ce-i revin din tratatele la care este parte. Tratatele ratificate de Parlament, potrivit legii, fac parte din dreptul intern.

România a aderat la Consiliul Europei (CE) ca urmare a deciziei de la 4 octombrie 1993, formulată prin Rezoluția nr. 37/1993 a Comitetului de Miniștri al CE. Aderarea la CE, organizație fondată pe principiile respectului pentru drepturile și libertățile fundamentale ale omului, pentru valorile democrației și ale statului de drept, a constituit o etapă obligatorie în promovarea demersurilor României de aderare la Uniunea Europeană (UE) și la Organizația Tratatului Nord-Atlantic (NATO).

Prin O.G. nr.46/1999 a fost aprobată participarea României la Grupul de state împotriva corupției (GRECO), instituit prin Rezoluția Consiliului Europei nr.(99)5 din 1 mai 1999, deoarece fenomenul corupției reprezenta și reprezintă în continuare o amenințare serioasă împotriva statului de drept, democrației, drepturilor omului, echității și justiției sociale, împiedicând dezvoltarea economică, punând în pericol stabilitatea instituțiilor democratice și bazele morale ale societății.

Statul Român și-a respectat constant obligațiile internaționale ce îi reveneau din participarea la Grupul de state împotriva corupției (GRECO). Spre exemplu, Curtea Constituțională a României face referire (Decizia nr.138/2008) la rapoartele GRECO în motivarea respingerii unor critici de neconstituționalitate. De asemenea, deseori, Parlamentul României a legiferat în dorința respectării concluziilor raportorilor GRECO. Inclusiv modificările aduse legilor justiției au avut un astfel de fundament, Comisia Specială Comună fiind creată și pentru ”punerea în acord a rapoartelor GRECO cu prevederile Codului penal și Codului de procedură penală (Raportul de evaluare a României privind incriminările, 3 decembrie 2010, pct. 23, 24, 111, 112; Raportul de conformitate privind România, 7 decembrie 2012, Regretul efectiv, caracterul total automat și obligatoriu al clauzei de nepedepsire a denunțătorului, pct. 34, 37-42; Al doilea raport de conformitate a României, 12 decembrie 2014, pct. 35-37, 40, 41), așa cum reiese din Hotărârea nr. 69/2017 privind constituirea Comisiei speciale comune a Camerei Deputaților și Senatului pentru sistematizarea, unificarea și asigurarea stabilității legislative în domeniul justiției.

Asociația Forumul Judecătorilor din România reiterează solicitările adresate, în nenumărate rânduri, puterii executive și puterii legislative de a lua toate măsurile necesare conformării cu toate aspectele ce pun în primejdie statul de drept în România, constant reliefate atât de Comisia de la Veneția, Consiliul Consultativ al Judecătorilor Europeni sau GRECO (organisme din cadrul Consiliului Europei), dar și de Comisia Europeană și multe alte entități ale Uniunii Europene.
