Marius Bulancea, candidat la funcția de procuror european: Au existat situații în care angajați ai Ministerului Public au furnizat informații presei

Interviurile organizate pentru funcția de procuror european au început la Ministerul Justiției. Dacă inițial s-au înscris 8 candidați, astăzi, doi nu s-au prezentat, respectiv Nicoleta Nolden şi Radu Răzvan Horaţiu, iar Cătălin-Laurenţiu Borcoman a solicitat amânarea interviului pentru data de 23 iulie deoarece nu este în ţară. Candidaților li s-au testat cunoștințele de limbă engleză și franceză. 

„Comisia este alcătuită legal, din persoanele care au fost şi în trecut, este şi preşedinta CSM, comisia este condusă de ministrul Justiţiei şi alţi reprezentanţi din direcţiile specifice din Ministerul Justiţiei. Au fost opt candidaţi, unul s-a retras ieri, ne-a anunţat că nu se mai prezintă la interviu, dat fiind faptul că ocupă altă poziţie, deci avem şapte candidaţi, iar procedura este foarte transparentă, o să fie şi live, conform normelor legale. Interviul are loc în ordine alfabetică. Sper să terminăm astăzi. Vă anunţ de pe acum că un candidat ne-a rugat, dat fiind faptul că se află în concediu de odihnă şi într-o altă delegaţie, ne-a rugat ca să avem interviul pe 23”, a declarat Ana Birchall, înainte de interviuri.

Marius Bulancea: Justiţia trebuie să se facă în sala de judecată

Marius Bogdan Bulancea este șeful Secției de combatere a infracțiunilor asimilate infracțiunilor de corupție din cadrul DNA. A făcut parte din echipa de anchetă în dosarul „Gala Bute”, în care este judecată Elena Udrea.

La interviul de astăzi, Marius Bulancea a recunoscut că au fost scurgeri de informații din dosare către presă. El a mai spus că „justiția trebuie să se facă în sala de judecată și nu la televizor”

„Specificul activității DNA face ca fiecare dosar să fie urmărit de mass-media. Presa este interesată să obțină informații din dosare. Sunt informații care nu ar trebui să fie publice. Au existat situații în care angajați ai Ministerului Public au furnizat informații presei. Nu s-a reușit întotdeauna păstrarea confidențialității. Eu nu am avut probleme în acest sens”, a precizat Marius Bulancea.

Întrebat dacă a înregistrat eșecuri și dacă sunt lucruri pe care le-ar face altfel, procurorul DNA spune că „se puteau face și altfel anumite lucruri, au existat și achitari”.

„Sunt lucruri normale într-o activitate când există un număr mare de cauze, iar pentru anumite infracțiuni nu există o jurisprudența consolidată. Sunt chiar și situații în care două instanțe nu văd la fel o cauza și dau decizii diferite”, a completat magistratul.

Claudiu Dumitrescu: Nu am ce să îmi reproşez. Mereu e ceva de îmbunătăţit

Constantin Claudiu Dumitrescu este șeful Serviciului de combatere a infracțiunilor de corupție împotriva intereselor financiare ale UE din cadrul DNA. În perioada 2011 – 2013, a fost detașat în funcția de șef al Departamentului de Lupta Antifraudă.

„Eu am respectat legea, dispozițiile legale, Am fost o persoană verificată de Inspecția Judiciară, nu au fost găsite probleme, am încercat să păstrez un echilibru, e important să comunici cu colegii, nu am ce să-mi reproșez. Dacă ne referim la greșeli, mereu este ceva de îmbunătățit”, a spus Claudiu Dumitrescu.

„16 ani am stat încremenit aici. E o provocare, faci altceva. Provocarea vine și din faptul că toată chestiunea e la început. Acel colegiu funcționează sub coordonarea procurorului șef, dar acolo se vor face regulile jocului, acel colegiu e de conducere”, subliniază procurorul, adăugând cât de important este „să păstrezi un echilibru și să comunici cu colegii”.

Un alt candidat audiat a fost Laura Ecedi Stoisavlevici, procuror DIICOT.

Audierile, reluate după şedinţa de Guvern

Audierile au fost întrerupte, urmând să fie reluate după şedinţa de Guvern.

În urma susţinerii interviului, comisia va selecta trei candidaţi, care vor fi incluşi în lista cu trei candidaturi pe care ministrul justiţiei o va înainta Consiliului Uniunii Europene.

Parchetul European (EPPO) va fi un parchet european independent responsabil cu investigarea, urmărirea penală şi trimiterea în judecată a autorilor infracţiunilor care aduc atingere intereselor financiare ale UE şi a complicilor acestora. Regulamentul (UE) 2017/1939 al Consiliului (1) privind EPPO a intrat în vigoare la 20 noiembrie 2017.

În conformitate cu articolul 120 din respectivul regulament, EPPO îşi va începe activitatea în urma unei decizii a Comisiei, odată ce acesta va fi înfiinţat, dar nu mai devreme de 3 ani de la data intrării în vigoare a Regulamentului privind EPPO.

Biroul Parchetului Public European ar urma să îşi înceapă activitatea până la sfârşitul anului 2020.
