CSM amenință cu sesizarea CCR impozitarea pensiilor speciale ale magistraților: Nu reprezintă un privilegiu

Consiliul Superior al Magistraturii (CSM) a reacționat dur la intenția Guvernului de a impozita pensiile speciale ale magistraților. Într-un comunicat public se precizează că „pensia de serviciu a magistraților nu reprezintă un privilegiu, este doar o compensație a inconvenientelor ce rezultă din rigoarea statutului special, căreia i se supun magistrații”.

Potrivit datelor statistice, pensia medie a magistraților este 18.180 de lei. Guvernul intenționează să plafoneze pensiile speciale la 10.000 de lei, urmând ca diferența să fie impozitată cu 90%.

CSM consideră că prin această impozitare se încalcă independența judecătorilor și procurorilor din România, astfel că, vor fi sesizate organismele internaționale iar decizia Guvernului va fi atacată la Curtea Constituțională

„În majoritatea statelor este instituită obligația constituțională de a garanta judecătorilor și procurorilor, la încetarea funcției, plata unei pensii al cărei nivel să fie cât mai apropiat posibil de nivelul ultimei remunerații, în acord cu jurisprudența europeană în materie.

În jurisprudența Curții Constituționale a României, cu referire și la decizii ale instanțelor similare din alte state ale Uniunii Europene, s-a statuat constant și fără echivoc că eliminarea pensiilor de serviciu ale magistraților contravine principiului independenței justiției, fiind o măsură neconstituțională, dat fiind statutul special al acestei categorii profesionale.

În același sens, contravin principiului independenței justiției și măsurile echivalente, precum cele preconizate, care în fapt ar diminua beneficiul și cuantumul pensiilor magistraților, reprezentând o eliminare mascată a acestora.

Garantarea existenței, stabilității și cuantumului pensiei magistraților este un corolar al dispozițiilor legislative speciale privind statutul magistraților, inclusiv al celor care instituie incompatibilități și interdicții pe care legea le stabilește în sarcina acestei categorii profesionale pe tot parcursul carierei.

Subliniem că potrivit art. 125 și art. 132 din Constituția României, funcția de magistrat este incompatibilă cu orice altă funcție publică sau privată, cu excepția funcțiilor didactice din învățământul superior.

Totodată, nu poate fi ignorat faptul că la nivel infraconstituțional, Legea 303/2004 privind statutul judecătorilor și procurorilor stabilește o serie de incompatibilități și interdicții pentru judecători și procurori, cum ar fi cele de a desfășura activități comerciale, de arbitraj în litigii civile, comerciale sau de altă natură, de a avea calitatea de asociat sau membru în organele de conducere, administrare sau control la societăți civile, societăți comerciale, inclusiv bănci sau alte instituții de credit, societăți de asigurare ori financiare, companii naționale, societăți naționale sau regii autonome ori de a avea calitatea de membru al unui grup de interes economic.

Trebuie reamintit că independența justiției, ca garanție constituțională, include securitatea financiară a magistraților, care presupune și asigurarea unei garanții sociale, cum este pensia de serviciu a magistraților, precum și apărarea acesteia, ca parte integrantă a stabilității lor financiare, în aceeași măsură cu care apără celelalte garanții ale acestui principiu.

Pensia de serviciu nu reprezintă un privilegiu, ci este justificată în mod obiectiv, constituind o compensație parțială a inconvenientelor ce rezultă din rigoarea statutului special căruia trebuie să i se supună magistrații și care impune obligații și interdicții pe care celelalte categorii de asigurați nu le au, fiindu-le interzise activități ce le-ar putea aduce venituri suplimentare, care să le asigure posibilitatea efectivă de a-și crea o situație materială de natură să le ofere după pensionare menținerea unui nivel de viață cât mai apropiat de cel avut în timpul activității, aspecte tranșate în repetate rânduri în jurisprudența Curții Constituționale.

Nu în ultimul rând, documentele internaționale stabilesc, printre alte importante măsuri pe care statele membre urmează să le adopte, și pe aceea de a veghea ca statutul și remunerația judecătorilor și procurorilor să fie pe măsura demnității profesiei lor și a responsabilității pe care și le asumă.

Consiliul Superior al Magistraturii reiterează că statutul constituțional al magistraților, statut dezvoltat prin lege organică și care cuprinde o serie de incompatibilități și interdicții, precum și responsabilitățile și riscurile pe care le implică exercitarea acestor profesii, impune acordarea pensiei de serviciu ca o componentă a independenței justiției, garanție a statului de drept, prevăzut de art. 1 alin. 3 din Legea fundamentală.

Apărând independența judecătorilor și procurorilor din România, Consiliul Superior al Magistraturii nu va tolera sub nicio formă afectarea statutului magistratului pentru a cărui prezervare va efectua toate demersurile care se impun, inclusiv sesizarea organismelor internaționale și a Curții Constituționale cu un conflict juridic de natură constituțională.”, se arată în comunicatul CSM.
