DIICOT: în cazul dispariției tinerei de 18 ani, procurorii aveau indicii că a fost răpită in scopul exploatării sexuale
Procurorii de la DIICOT au în cercetare primul dosar de disparitie al tinerei Mihaela, in varsta de 18 ani, încă din luna aprilie. Pentru că niciun indiciu nu i-a dus spre un făptuitor, se cerceta numai fapta. În luna aprilie, polițiștii de la Secția din comuna Diosti au fost sesizați că o tânăra a plecat de acasă în orașul Caracal și nu s-a mai întors. În acest caz, dosarul s-a aflat în lucru la DIICOT Craiova.
Procurorii aveau indicii că tânăra a fost răpită în scopul exploatării sexuale. Și asta pentru că bunicul fetei a fost contactat telefonic, în datele de 15.04.2019 și 19.04.2019, de către persoane necunoscute, care i-au comunicat că aceasta nu mai dorește să se întoarcă acasă, fiind pe teritoriul Elveției.
Comunicatul DIICOT:
Biroul de informare și relații publice este abilitat să aducă la cunoștința opiniei publice următoarele:
În data de 15.04.2019, lucrătorii Postului de Poliție Dioști au fost sesizați, prin plângere, de către o persoană de sex masculin, din comuna Dioști, sat Radomir, jud. Dolj, cu privire la faptul că, nepoata sa, în vârstă de 18 ani, a plecat în mod voluntar de la domiciliul din comuna Dioști către municipiul Caracal și nu a mai revenit. Prin ordonanța din 18.04.2019, Secția 4 Poliție Rurală Coșoveni – Postul de Poliție Coșoveni a dispus începerea urmăriririi penale sub aspectul infracțiunii de lipsire de libertate în mod ilegal, prev. de art.205 alin.1 C.p.
Prin ordonanța din 30.05.2019, Parchetul de pe lângă Judecătoria Craiova a dispus declinarea dosarului către D.I.I.C.O.T. – S.T. Craiova, în vederea efectuării de cercetări cu privire la infracțiunea de trafic de persoane, prev. de art.210 C.p. alin.1 lit. a C.p., având în vedere că bunicul fetei a fost contactat telefonic, în datele de 15.04.2019 și 19.04.2019, de către persoane necunoscute, care i-au comunicat că aceasta nu mai dorește să se întoarcă acasă, fiind pe teritoriul Elveției.
Prin ordonanța din 06.06.2019 a Direcţiei de Investigare a Infracţiunilor de Criminalitate Organizată şi Terorism – Serviciul Teritorial Craiova s-a dispus începerea urmăririi penale in rem cu privire la infracțiunea de trafic de persoane, prev. de art.210 alin.1 lit. a C.p, raportat la împrejurările cauzei, la modul și mijloacele de săvârșire, la datele personale ale victimei, la locul de unde fuseseră inițiate apeluri telefonice către familia victimei, considerându-se că sunt indicii temeinice de recrutare a victimei prin răpire/constrângere în scopul exploatării sexuale.
La data de 26.07.2019,în baza art. 63 C.pr.pen. rap. la art. 43-45 C.pr.pen., cu aplic. art. 50 C.pr.pen. și a art. 11 alin. 1 pct. 5 din O.U.G. 78/2016, Direcția de Investigare a Infracțiunilor de Criminalitate Organizată și Terorism – Serviciul Teritorial Craiova a solicitat Parchetului de pe lângă Tribunalul Olt declinarea competenței de soluționare a cauzei penale înregistrată la această unitate de parchet în vederea reunirii la cauza penală ce are ca obiect infracțiunea de trafic de persoane, prev. de art.210 C.p. alin.1 lit. a C.p., având în vedere faptul că, din datele obținute de la Parchetul de pe lângă Judecătoria Caracal și ulterior din surse publice, au rezultat indicii că între cauza penală înregistrată la Parchetul de pe lângă Tribunalul Olt și cauza penală a Direcţiei de Investigare a Infracţiunilor de Criminalitate Organizată şi Terorism – Serviciul Teritorial Craiova există cazul de reunire prev. de art. 43 alin. 2 litera a C.pr.pen.. Astfel, s-a constatat același modus operandi (răpire a unei persoane de sex feminin tânără, pieton ce apela la serviciile automobiliștilor ocazionali, inclusiv apeluri telefonice adresate membrilor familiei victimei prin care s-a încercat liniștirea lor sau inducerea unei piste false),precum și împrejurările de timp și de loc.
Facem precizarea că în cauza înregistrată la Direcţia de Investigare a Infracţiunilor de Criminalitate Organizată şi Terorism – Serviciul Teritorial Craiova au fost efectuate cercetări cu privire la faptă, iar din datele existente până în prezent nu a rezultat vreo bănuială rezonabilă cu privire la identitatea făptuitorilor.
