Delegație MCV, la București. Ana Birchall prezintă situația justiției din România

Ana Birchall s-a întâlnit, marți, cu delegația MCV, aflată în aceste zile la București. Este prima vizită a reprezentanților MCV de când Ana Birchall a preluat ministrul Justiției.

Delegația MCV analizează stadiul celor 20 de obligații impuse României la finalul anului trecut, referitoare la funcționarea sistemului judiciar. De asemenea, se analizează și efectele modificărilor legislative din ultima perioadă.

Zilele următoare, membrii MCV se vor întâlni cu reprezentanții de la ÎCCJ, DNA, Ministerul Public și ANI.

Ultimul raport al MCV a fost întocmit în noiembrie, anul trecut, pe vremea când ministru al Justiției era Tudorel Toader. Raportul viza adoptarea legilor justiţiei şi presiunile asupra independenţei sistemului judiciar, în special asupra DNA, care ar genera dubii privind ireversibilitatea progreselor înregistrate de România în ultimii 10 ani.

„Autoritățile române vor continua dialogul instituțional și transparent cu reprezentanții Comisiei pe marginea recomandărilor din cadrul MCV”, susține ministrul Ana Birchall.

În cadrul discuțiilor, partea română s-a angajat că va analiza fiecare din cele douăzeci de puncte conținute în raportul MCV.

„România este o țară profund atașată valorilor europene și statului de drept, preocupată de respectarea drepturilor și libertăților fundamentale ale cetățenilor săi și ale cetățenilor europeni. Apreciem deschiderea colegilor de la Bruxelles pentru un dialog constructiv în scopul identificării celor mai bune soluții. Autoritățile române vor continua acest dialog instituțional și transparent cu reprezentanții Comisiei, în vederea ridicării Mecanismului de Cooperare și Verificare”, a subliniat ministrul român al justiției.

Raport MCV 2018/ Ana Birchall: Recomandările sunt disproporționate, inaplicabile

Ana Birchall nu este de acord cu raportul MCV de anul trecut, afirmând la acea vreme că tratamentul pe care România îl primește de la UE este „inegal”. Aceasta a spus, la acea vreme, că recomandările MCV sunt „disproporționate” și „inaplicabile”.

„Guvernul României a prezentat argumente solide privind modificările legislative precum și clarificări de fiecare dată când a fost nevoie, în baza principiului cooperării loiale între instituțiile UE și statele membre.

Suntem deschiși cooperării strânse și deschise cu forurile UE, însă cerem tratament egal. Nu putem fi de acord ca la deschiderea, implicarea și cooperarea autorităților române să se răspundă cu ostilitate.

România a făcut progrese semnificative, iar acest lucru nu este, din păcate, reflectat corect în interiorul raportului MCV.

Recomandările MCV sunt disproporționate, inaplicabile și prin adăugarea arbitrară de noi condiționalități depășesc atât cadrul național constituțional cât și sfera dreptului primar al Uniunii Europene.

E o realitate că MCV, de foarte multe ori, a fost folosit ca armă politică, cu tot felul de „moving targets”, mereu alte recomandări, fiind folosit împotriva unor interese importante ale României, şi mă refer de exemplu la aderarea Romaniei la spaţiul Schengen avand in vedere ca Romania indeplineste toate criteriile de aderare la spatiul Schengen actionand ca un membru de facto inca din anul 2010.

Nu e niciun motiv pentru care România să poată să mai fie sub controlul MCV. Sunt alte instrumente care se pot aplica şi se aplică tuturor statelor membre, cum este raportul de ţară din semestrul european.

Justitia se face in sala de judecata exclusiv pe baza probatoriului existent la dosar, legal obtinut. Este un principiu fundamental pe care l-am invatat in prima zi la facultatea de drept. Apararea si protejarea drepturilor si libertatilor fundamentale ale omului sunt valori democratice pe care fiecare dintre noi avem datoria si obligatia sa le respectam.

În ceea ce privește rezoluția PE privind România, aceasta rezoluție este una profund politică, parte din jocul politic în perspectiva viitoarelor alegeri europarlamentare.

Este dificil de înțeles, de exemplu, logica în virtutea căreia în rezoluție sunt criticate articole din Codurile penale care au fost deja declarate neconstituționale și care oricum nu se vor aplica. La fel de neinteles sunt si criticile aduse organizarii referendumului privind familia traditionala, in conditiile in care acest referendum a raspuns unei initiative cetatenesti legitime, iar fiecare stat membru are dreptul sa dispuna organizarea unor astfel de consultari democratice.
