Daniel Barbu se apără după acuzațiile DNA

Daniel Barbu se apără după acuzațiile DNA, acesta explicând, într-o conferință de presă, atribuțiile pe care le avea în calitate de președinte al AEP.

Barbu a fost pus sub învinuire de DNA, fiind acuzat că în perioada în care a condus Autoritatrea Electorală Permanentă nu ar fi urmărit destinația subvențiilor pentru partide și că ar fi oprit mai multe controale.

Cum se apără fostul președinte al Autorității Electorale Permanente

Daniel Barbu susține că nu îl cunoștea pe Mircea Drăghici, menționând că au avut discuții doar la întâlniri publice.

„Ne-am întâlnit de câteva ori în cursul anului 2017, dar în situații publice. Nu-l cunoșteam pe domnul Drăghici, decât după nume. Eu am fost senator, domnia sa a fost deputat. Știam că e unul din autorii, împreună cu Mihai Voicu, legii 334, nici nu știam că e trezorierul PSD. Am avut câteva discuții în contexte publice în 2017. Din fericire pentru poziția mea, nu am avut niciun fel de convorbire, de la mulți ani de Crăciun, de Anul Nou cu domnul Drăghici în 2018”, a declarat Daniel Barbu.

Daniel Barbu precizează că nu a blocat niciun control la vreun partid, această măsură nefiind în atribuția exclusivă șefului Autorității.

„Nu am stopat, oprit, blocat, niciun fel de control, la niciunul din partidele politice pe durata mandatului meu ca președinte al AEP. (..) În timpul mandatului meu, nu am dat dispoziţii nici de începere, nici de încetare a verificărilor. Astfel de măsuri se iau exclusiv prin ordin de serviciu semnat de directorul general al Departamentului. S-ar fi stopat unele controale aflate în curs. DNA admite, prin urmare, că unele controale au fost totuşi iniţiate, în speţă în noiembrie 2018 la PSD, dar şi la alte partide. Evident, prin ordin de serviciu al directorului general al Departamentului de Control. Am solicitat atunci Curţii de Conturi să se alăture activităţii de control desfăşurată de AEP, deoarece, potrivit legii 334, nu numai că ambele instituţii sunt abilitate să controleze utilizarea subvenţiilor publice de către partide, dar legiuitorul a prevăzut expressis verbis ca, controalele celor două instituţii să se desfăşoare simultan. În ianuarie, Curtea de Conturi ne-a informat că şi-a programat controlul începând cu luna august a acestui an. Pentru a nu părea că pledez pro domo, reconstitui următorul fapt cu ajutorul actualului preşedinte al AEP, pe atunci secretar general. Deşi a luat cunoştinţă prin angajaţii AEP de unele nereguli cu referire la utilizarea subvenţiilor, nu ar fi fost de acord cu solicitarea unuia dintre angajaţi de a se relua controalele suspendate. Mi s-a adus la cunoştinţă într-adevăr o notă preliminară de control a jumătate din membrii echipei de control de la PSD în care erau enumerate unele nereguli. Menţionez că ceilalţi membri ai echipei nu au subscris aceste note preliminare şi parţiale. Este adevărat, de asemenea, că domnul Toma Costreie, acesta fiind „unul dintre angajaţii” evocaţi de DNA, mi-a solicitat insistent în ultimele zile ale mandatului meu reluarea controlului. La propunerea lui, am convocat pe 24 februarie o reuniune de lucru cu cei doi vicepreşedinţi, secretarul general, directorul Compartimentului legislativ, directorul Direcţiei juridice şi, fireşte, directorul general al Departamentului de control”, a completat Barbu.

Acuzațiile DNA

Potrivit procurorilor, în perioada 27 mai 2017 – 27 februarie 2019, în calitate de președinte al Autorității Electorale Permanente, nu ar fi urmărit destinația subvențiilor acordate partidelor.

Mai exact, susține DNA, Barbu nu ar fi dispus verificări anuale pentru fiecare partid, privind veniturile și cheltuielile, și ar fi stopat unele controale aflate în curs.

„Concret, printr-o adresă din data de 22.01.2019, ca urmare a unei scrisori adresate Autorității Electorale Permanente de către trezorierul unui partid, în calitate de președinte al AEP, suspectul ar fi dispus în mod discreționar, oprirea controalelor inițiate prin ordine de serviciu de către directorul structurii competente, controale ce vizau respectiva formațiune politică.

În dispozițiile Legii nr. 334/2006 privind finanțarea activității partidelor politice și a campaniilor electorale nu există nicio prevedere legală care să permită oprirea unui control dispus de directorul structurii competente din cadrul AEP.
Deși a luat cunoștință prin angajații AEP de ”unele nereguli cu referire la utilizarea subvențiilor ”, nu a fost de acord cu solicitarea unuia dintre angajați săi de a se relua controalele suspendate din dispoziția sa, preferând să își dea demisia în data de 27.02.2019 din funcția de președinte al AEP”, explică DNA.

DNA susține că, prin conduita lui, i-ar fi permis lui Mircea Drăghici, trezorierul PSD, să utilizeze în interes personal fonduri aparținând PSD. Drăghici susține că este nevinovat.
