Astrid Fodor se poate întoarce la Primăria Sibiu/Edilul susține că a rămas fără surse de venit

Primarul suspendat al Sibiului, Astrid Fodor, se poate întoarce la Primărie. Decizia a fost luată de Tribunalul Sibiu. Instanţa a decis suspendarea ordinului emis de prefectul judeţului Sibiu, Adela Muntean, prin care Astrid Fodor a fost suspendată din funcţie.

ȘTIREA INIȚIALĂ:

Fostul primar al municipiului Sibiu, Astrid Fodor, vrea să se intoarcă la Primărie. Fodor a contestat la Tribunalul Sibiu decizia prefectului de a o suspenda din funcție în urma deciziei Înaltei Curți care a stabilit că aceasta s-a aflat în incompatibilitate. Potrivit sentinței Curții Supreme, Astrid Fodor a fost în incompatibilitate atunci când era viceprimar, dar și membru în consiliile de administrație ale unor școli din Sibiu.

Potrivit Agerpres, avocata fostului primar a susținut în instanță că acesta a rămas fără nicio sursă de venit, după ce a fost suspendată din funcție. În plus avocata a mai cerut ca Astrid Fodor să nu fie sancţionată ca edil pentru ceva ce a făcut în mandatul trecut, când a fost unul din cei doi viceprimari ai lui Klaus Iohannis la Sibiu.

În replică, avocata care reprezintă Prefectura Sibiu în proces a spus că legea trebuie respectată şi că activitatea Primăriei Sibiu nu este afectată de plecarea lui Astrid Fodor, atribuţiile ei fiind preluate de fostul viceprimar, Corina Bokor, printr-o hotărâre adoptată de consilierii municipali.

Astrid Fodor solicită instanţei să dispună constatarea nulităţii ordinului Instituţiei Prefectului, „întrucât este emis în mod nelegal”, precum şi repunerea părţilor în situaţia anterioară cu plata indemnizaţiei cuvenite începând cu data emiterii ordinului şi până la reluarea funcţiei de primar al municipiului Sibiu.

Primarul Sibiului, Astrid Fodor, a fost suspendat din funcţie de către prefectul Adela Muntean, în baza sentinţei definitive a Înaltei Curţi de Casaţie şi Justiţie, care confirmă starea de incompatibilitate constatată de Agenţia Naţională de Integritate.

CONTEXT

ANI a decis, în 2015, că Astrid Fodor s-a aflat în stare de incompatibilitate în perioada 2012-2014, în care a ocupat simultan atât funcţia de viceprimar, cât şi calitatea de membru al consiliilor de administraţie în două instituţii de învăţământ din oraş – Colegiul German „Samuel von Brukenthal” şi Grădiniţa cu program prelungit nr. 37. Fodor a explicat de mai multe ori că la momentul în care a făcut parte din acele consilii de administraţie avea şi calitatea de consilier local, iar cadrul normativ de la acea dată o obliga ca, în calitate de ales local, să deţină calitatea de membru neremunerat în consiliile de administraţie respective.

Astrid Fodor a atacat raportul ANI la Curtea de Apel Alba Iulia, care i-a dat dreptate în vara anului 2016. ANI a atacat cu recurs hotărârea de la Alba, iar Înalta Curte a emis în luna mai decizia de admitere a recursului ANI, iar apoi a recurs la trimiterea motivaţiei către părţile în proces şi Instituţia Prefectului – Judeţul Sibiu.

Viceprimarul municipiului Sibiu, Corina Bokor, (FDGR) a fost aleasă vineri, 5 iulie, într-o şedinţă extraordinară a Consiliului Local, primar interimar, în urma suspendării lui Astrid Fodor din funcţie. Potrivit deciziei Consiliului Local Sibiu, Corina Bokor a fost desemnată „să îndeplinească atribuţiile conferite de lege primarului în perioada de vacanţă a funcţiei de primar al Municipiului Sibiu”.
