Klaus Iohannis cere vot anticipat, timp de 8 zile, la alegerile prezidențiale

Scrisoarea trimisă de președintele Klaus Iohannis premierului Viorica Dăncilă dar și celor doi șefi de la Senat și de la Camera Deputaților conține modificări majore ale legii electorale.

Klaus Iohannis cere sesiune extraordinară pentru ca parlamentarii sa poată adopta, printre alte măsuri organizatorice, introducerea votului anticipativ, timp de 8 zile, la alegerile prezidențiale.

Mărirea numărului de secții de votare din străinătate, accesul tuturor persoanelor aflate la rând la vot, număr mai mare de ștampile in secțiile de votare, digitalizarea listelor electorale, sunt doar câteva din propunerile președintelui.

Atât la alegerile prezidențiale din 2014, dar si la cele europarlamentare din 26 mai, mii de români din străinătate nu au mai apucat să voteze.

Mai jos, schimbările cerute de Iohannis, schimbări care ar trebui să fie adoptate până la sfârșitul acestei sesiuni parlamentare:

1. Debirocratizarea procesului de votare în secțiile de votare din străinătate
Având în vedere că înscrierea în listele electorale suplimentare a fost operațiunea cea mai cronofagă, în cazul secțiilor din străinătate poate fi conceput un sistem în care listele suplimentare să fie generate în mod electronic – completarea acestora să se facă în mod automat în momentul scanării buletinului cu ajutorul tabletei puse la dispoziție de STS. Pentru confirmare, alegătorii ar putea semna pe un pad de semnătură electronică (similar celor existente deja în sistemul bancar sau perifericelor sistemului de gestionare a documentelor de călătorie E-Pass).

2. Dotarea corespunzătoare a secțiilor de votare
Pentru a accelera verificarea identității alegătorului, trebuie mărit numărul de operatori ai Sistemul informatic de monitorizare a prezenței la vot și de prevenire a votului ilegal (SIMPV), și corespunzător numărul de tablete, cu introducerea posibilității ca membrii secției de vot să poată și ei opera SIMPV (în prezent, există un singur operator).
Numărul de cabine de vot și de ștampile cu mențiunea ”VOTAT” în toate acele secții de votare din străinătate unde au existat situații care au condus la împiedicarea exercitării dreptului de vot de către cetățeni români să fie mărit acolo unde condițiile permit.
Să existe un număr rezonabil de ștampile de rezervă cu mențiunea ”VOTAT” pentru a fi folosite în caz de pierdere sau sustragere a ștampilelor cu mențiunea ”VOTAT” care sunt folosite în procesul de votare.
Să existe un număr suficient de buletine de vot (au existat cazuri în care unele secții de vot au epuizat buletinele de vot încă de la orele amiezii).
Să fie crescută indemnizația pentru membrii secțiilor de votare.
Să fie identificate formule flexibile și funcționale pentru înlocuirea membrilor secțiilor care nu se prezintă la secție în ziua votului.

3. Modificarea legislației electorale în privința procedurilor de urmat la închiderea secțiilor
Corectarea în lege a sintagmei limitative care se referă doar la alegătorii care se află la ora 21:00 ”în sala unde se votează”.
Includerea în lege în mod expres a prevederii că toți alegătorii care la ora 21:00 așteaptă (la coadă) să își exercite dreptul de vot vor putea face acest lucru (”Toți alegătorii care își așteaptă rândul la ora 21:00 pentru exercitarea dreptului de vot la oricare dintre secțiile de votare vor putea să își exercite acest drept.”).
Includerea prevederii explicite în lege a posibilității de extindere a programului de votare la solicitarea argumentată a președintelui secției de votare.
Corelat cu aceste schimbări legislative, păstrarea deschisă a SIMPV atât timp cât alegătorii încă își mai exercită dreptul de vot și posibilitatea ca tabletele să poată funcționa și off-line, pentru ca eventualele disfuncționalități ale SIMPV să nu afecteze menținerea evidenței votanților.
Debirocratizarea procesului de votare în secțiile din străinătate, dotarea corespunzătoare a secțiilor existente și clarificarea procedurilor de urmat la închiderea votării nu sunt suficiente pentru a asigura condiții optime pentru exercitarea dreptului de vot dacă nu se iau și alte măsuri complementare, precum mărirea numărului de secții de votare din străinătate, introducerea votului anticipat pentru alegerea Președintelui României și extinderea votului prin corespondență la toate tipurile de alegeri (în prezent este utilizat doar la alegerile parlamentare).

4. Mărirea numărului de secții de votare din străinătate
Mărirea numărului de secții de votare din străinătate poate fi făcută la inițiativa Ministerului Afacerilor Externe sau de către Autoritatea Electorală Permanentă.
Evaluarea numărului de alegători pentru alegerile prezidențiale, pe care o va face Ministerul Afacerilor Externe, nu poate duce, în mod evident, decât la o mărire a numărului secțiilor de votare din străinătate, în special în țările și în localitățile unde cetățenii români nu au putut să își exercite dreptul de vot.
În paralel, Autoritatea Electorală Permanentă poate organiza secții de votare în localitățile în care își au domiciliul sau reședința, conform Registrului Electoral, cel puțin 100 de alegători, prin extinderea aplicabilității unei prevederi (art. 23 alin. (3)) din Legea nr. 208/2015 privind alegerea Senatului și a Camerei Deputaților, precum și pentru organizarea și funcționarea Autorității Electorale Permanente.

5. Introducerea votului anticipat pentru alegerea Președintelui României
Introducerea votului anticipat timp de opt zile, începând cu sâmbăta din săptămâna anterioară celei care se încheie cu ziua alegerilor, în secțiile de votare din străinătate organizate în ambasade, reprezentanțe permanente, consulate generale și institute culturale.
Votul anticipat se va organiza atât pentru primul tur de scrutin, cât și pentru al doilea, cu un număr de zile egal, dacă Curtea Constituțională aduce la cunoștința publică numele celor doi candidați care vor participa la cel de-al doilea tur de scrutin cel târziu în ziua de vineri care urmează zilei alegerilor din primul tur de scrutin.
Dacă Curtea Constituțională face acest anunț mai târziu de ziua de vineri care urmează zilei alegerilor din primul tur de scrutin, perioada de vot anticipat pentru al doilea tur de scrutin va începe automat în ziua care urmează zilei în care Curtea Constituțională aduce la cunoștință publică numele celor doi candidați care vor participa la cel de-al doilea tur de scrutin.
Durata zilei de vot în ziua în care se organizează votul anticipat nu poate depăși opt ore și se va întinde, de regulă, în intervalul de timp 9:00-17:00.

6. Extinderea exercitării dreptului de vot prin corespondență la alegerea Președintelui României și la toate celelalte tipuri de alegeri
Pentru a facilita exercitarea dreptului de vot de către cetățenii români cu domiciliul sau reședința în alte localități decât cele în care se organizează secții de votare, trebuie extinsă aplicabilitatea Legii nr. 288/2015 privind votul prin corespondență și la alegerile pentru Președintele României, dar și la celelalte tipuri de alegeri.
Votul prin corespondență a fost deja utilizat la alegerile pentru Senat și Camera Deputaților din 2016 cu un succes mai degrabă moderat, datorită noutății sale printre mecanismele electorale folosite în România. În aceste condiții, extinderea sa la alte tipuri de alegeri presupune un efort de comunicare publică susținut din partea autorităților publice.
Întrucât votul prin corespondență presupune înscrierea prealabilă a alegătorului în Registrul Electoral, extinderea acestui tip de vot la alte tipuri de alegeri ar încuraja înscrierea în Registrul Electoral, fapt care ar facilita în viitor organizarea alegerilor în secțiile de vot din străinătate.
Existența a două tururi de scrutin pentru alegerile prezidențiale nu este un impediment pentru extinderea aplicabilității legii privind votul prin corespondență la acest tip de alegeri:
Înaintea primului tur de scrutin, alegătorul primește prin poștă buletinul de vot prin corespondență pentru primul tur de scrutin și elementele de siguranță ale buletinului de vot atât pentru primul, cât și pentru cel de-al doilea tur de scrutin, alături de două autocolante cu mențiunea ”VOTAT”. După ce este anunțat oficial rezultatul primului tur de scrutin, alegătorul poate să descarce de pe site-ul Biroului Electoral Central și să imprime buletinul de vot pentru al doilea tur de scrutin pe care îl securizează prin aplicarea elementului de siguranță primit, după care aplică autocolantul cu mențiunea ”VOTAT” pe unul dintre cei doi candidați rămași în cursă.
Plicul poate fi trimis fie la misiunea diplomatică din țara în care își are domiciliul sau reședința alegătorul, fie în țară, pe adresa biroului electoral special pentru votul prin corespondență.
Autoritățile statului român au obligația și responsabilitatea să pună în aplicare aceste măsuri pentru a se asigura că toți cetățenii români, din țară sau din străinătate, își vor putea exercita neîngrădit dreptul de vot.
