Scandalul audierii procurorilor CSM la Secția Specială | SURSE: Legătura dintre Kovesi și citarea lui Solomon și Deac
Citarea lui Nicolae Solomon, membru și fost vicepreședinte al Consiliului Superior al Magistraturii (CSM), la Secția Specială, este legată de respingerea acțiunii disciplinare împotriva Laurei Codruța Kovesi pe tema refuzului acesteia de a participa la o comisie de anchetă din Parlament, în ciuda unei decizii a CCR, potrivit unor surse. Citarea a dus la izbucnirea unui scandal. În vreme ce Secția pentru procurori a CSM a denunțat presiuni, SIIJ a transmis, prin intermediul Parchetului General, că dosarul nu vizează activitatea Secției pentru procurori ci modul de desfășurare a activității unora dintre membrii acesteia.
Pentru că Laura Codruța Kovesi a refuzat să meargă la comisia de anchetă parlamentară pe tema alegerilor din 2009, CCR a dat o decizie care, la vremea respectivă, o obliga pe Kovesi să se prezinte la comisie. Aceasta a refuzat în continuare, iar Inspecția Judiciară a considerat că fosta șefă a DNA a săvârșit o abatere disciplinară.
Acuzațiile Inspecției, respinse de procurorii CSM
Legea spune că, atunci când Inspecția Judiciară acuză un magistrat de abateri disciplinare, Secția pentru procurori/judecători (după caz) a CSM decide dacă respectivul magistrat este sancționat.
În cazul lui Kovesi, pe subiectul prezentării la comisia parlamentară, CSM a respins acuzațiile Inspecției și a refuzat să o sancționeze pe fosta șefă a DNA.
Ulterior, Inspecția Judiciară a contestat decizia Secției pentru procurori la Instanța Supremă, însă judecătorii le-au dat dreptate procurorilor din CSM și au decis că Laura Codruța Kovesi nu a greșit.
Plângere penală la SIIJ după decizia CSM
Refuzul membrilor Secției pentru procurori, de a o sancționa pe Kovesi, le-a adus o plângere penală. Site-ul Lumea Justiției a depus denunțul la Parchetul General în 2018, acuzându-i de abuz în serviciu și constituirea unu grup infracțional organizat, potrivit luju.ro.
La mai bine de un an și jumătate de la depunerea plângerii, Adina Florea l-a citat pe Nicolae Solomon, în calitate de martor, în dosarul deschis ca urmare a acestei plângeri, arată sursele mainnews.ro. Potrivit acestora, dosarul este încă in rem (nicio persoană nu a fost pusă sub acuzare). Nu este exclus ca și citarea lui Florin Deac, și el procuror – membru CSM, să aibă legătură cu același subiect.
Procurorii CSM acuză presiuni
,,Secția pentru procurori apreciază că citarea a doi membrii ai Secției în maniera arătată, în cauze aflate pe rolul SIIJ încă din 2018, precum şi scurgerea în media a informațiilor privind cele două activități procesuale, în contextul derulării procedurii de avizare parțial negativă a propunerilor Ministrului Justiției de ocupare a funcțiilor înalte la nivelul Ministerului Public şi al unei campanii media îndreptate împotriva membrilor Secției, reprezintă un factor de presiune şi de decredibilizare instituțională.
Secția pentru procurori informează opinia publică că va sesiza Comisia Europeană pentru a aduce la cunoștință aceste împrejurări”, a anunțat secția din cadrul CSM.
SIIJ: Dosarul nu vizează activitatea Secției pentru procurori
La rândul său, Secția Specială a transmis, prin intermediul Parchetului General, că dosarul este legat de felul în care și-au desfășurat activutatea unii membri CSM.
,,În cursul zilei de azi, 17 februarie 2020, procurorii Secției pentru investigarea infracțiunilor din justiție l-au audiat, în calitate de martor, pe domnul procuror Solomon Nicolae Andrei, membru al Consiliului Superior al Magistraturii. Dosarul penal în care a avut loc audierea nu vizează activitatea Secției pentru procurori, ca și componentă a Consiliului Superior al Magistraturii, ci vizează modul de desfășurare a activității unora dintre membrii Secției pentru procurori”, se arată în reacția SIIJ.
